Tacoma Electric Service, LLC
Terms and Agreement
This Service Contract ("Contract") is entered into between Tacoma Electric Service, LLC ("Contractor") and the client ("Client"), effective as of approved and signed quote date.
Services to be Provided
Contractor agrees to provide electrical services to the Client at the client-provided address. The services to be provided are as listed in the quote. Any additional services are as agreed upon by both parties.
Payment
The Client agrees to pay the Contractor the quoted sum for the services provided in the quote and under agreement of this Contract. Payment shall be made according to the following schedule:
To secure scheduled visit, 40% down payment is required
(If required) 50% payment is required at the rough-in stage
Remaining balance is due upon completion of work
For any unpaid balances not resolved at project completion, a late payment interest rate of 5% per week (equivalent to 0.714% per day) will be applied to the outstanding amount. Interest will accrue daily until the balance is paid in full.
Duration and Schedule
The Contractor shall make reasonable efforts to adhere to the agreed-upon schedule but shall not be liable for delays beyond its control. Scheduling may fall dependent on supply and demand issues.
Warranties and Guarantees
The Contractor warrants that all services provided under this Contract shall be performed in accordance with applicable industry standards. Additionally:
The Contractor shall guarantee the quality and safety of the work performed for a period of 10 years from the completion date.
The Contractor will be held responsible for any damages, including those to walls, only when directly attributable to negligence. Any damages resulting from factors beyond control or unforeseen circumstances will not be repaired at The Contractor’s expense.
Materials, including devices and fixtures, provided by the Contractor shall be covered by the manufacturer's warranty, if applicable, and/or up to 1 year from the completion date.
This warranty on materials does not cover damages incurred by alteration or movement by anyone other than the Contractor.
The Client is responsible for ensuring that all materials, whether installed or stored on-site, are adequately secured during the course of the project. In the event of theft or damage to materials due to insufficient security measures, The Client will be liable for the cost of replacement or repair.
However, The Contractor assumes responsibility for any theft or damage resulting directly from proven negligence on their part.
Permits and Inspections
The Contractor shall obtain all necessary permits and licenses required to perform the services under this Contract.
If required, The Contractor will oversee the scheduling of inspections, working collaboratively with the client. The Contractor may not be onsite for inspections, and The Client agrees to allow access to the property for inspections as required by local authorities. If an inspection is scheduled The Client must ensure an adult is present for the inspector. Failure to do so will result in a $65 trip fee paid by The Client before rescheduling.
Terms and Termination
Restrooms
A functional restroom must be accessible on-site. The Client has the option to provide restroom facilities, or The Contractor may supply them, with associated costs of $350 a week invoiced to The Client.
Animals On-Site
The Client understands and agrees that any and all animals that may inflict injury on The Contractor will be kept out of all work areas for the duration of the job. If at any time access to the work area is not available due to the presence of and potential harm from The Client’s pet(s), The Client agrees to reimburse The Contractor for expenses incurred for travel and lost time at the rate of $200.00 per man-hour lost, and current government mileage rate per mile per vehicle.
The Client understands and agrees that The Contractor will not attempt to enter any work area if The Client’s potentially harmful animal(s) have direct access to that area.
The Client also understands and agrees that The Contractor will not be responsible for any pet(s) leaving the property due to doors, windows, gates, or other openings on the property being left open due to work in progress.
Termination
Either party may terminate this Contract, with written notice, if the other party fails to remedy a material breach within 14 days of receiving notice.
If The Contractor terminates the Contract, The Contractor will provide 2-3 referrals.
If The Client wishes to cancel prior to start date, The Client must give at least 5 business days' notice, and will receive a refund of the deposit minus 10% or $600 + permit costs - whichever is less.
In the event of cancellation by The Client during the course of the project, The Client shall be responsible for reimbursing The Contractor for materials utilized and labor costs incurred for the duration of work completed up to the point of cancellation.
Change Orders
In the event of alterations or updates to the original scope of work, the contract may incorporate provisions for “Change Orders”. This ensures that any additional tasks or variations are formally documented, with agreed-upon adjustments to costs and timelines. Change Orders involve providing The Client with an updated price quote before commencing the task, which must be approved by The Client.
Insurance and Liability
The Contractor shall not be liable for any damages or injuries resulting from unforeseen circumstances, including but not limited to acts of nature, electrical malfunctions, or misuse by the Client.
Governing Law
This Contract shall be governed by the laws of Washington State. Any disputes arising under this Contract shall be resolved through arbitration in Washington State.
